Os Deputados que o presente subscrevem em conformidade com o art. 48 do Regimento Interno desta Casa de Leis e art. 17 &sect; 3&ordf; da Constitui&ccedil;&atilde;o Estadual de Goi&aacute;s, cuja motiva&ccedil;&atilde;o abaixo expl&iacute;cita, requerem a Vossa Excel&ecirc;ncia a constitui&ccedil;&atilde;o de uma <b>Comiss&atilde;o Parlamentar de Inqu&eacute;rito (CPI) para investigar a inefici&ecirc;ncia na Gest&atilde;o do Programa de Reconstru&ccedil;&atilde;o, Manuten&ccedil;&atilde;o e Conserva&ccedil;&atilde;o de Rodovias Estaduais &ndash; Rodovida.<\/b><o_p><\/o_p><\/span><\/p>\n<p class=\"MsoBodyText2\" style=\"margin-top:6.0pt;margin-right:0cm;margin-bottom: 6.0pt;margin-left:0cm;text-align:justify;tab-stops:2.0cm 99.25pt 106.35pt\"><span style=\"font-size: 12pt; line-height: 150%; font-family: Arial, sans-serif;\">&nbsp;<\/span><\/b><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/span><span style=\"font-family: \">O Estado &eacute; uma na&ccedil;&atilde;o que se organiza a partir do direito, consistindo em uma sociedade pol&iacute;tica e organizada, que tem como fonte prim&aacute;ria a Constitui&ccedil;&atilde;o Federal, a qual define em seu art. 1&ordm; a organiza&ccedil;&atilde;o pol&iacute;tica do Estado brasileiro. (TELLES, 2000).<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Nesse sentido, pode-se dizer que o Estado se trata de uma entidade movida pelos seus representantes que agem em prol de seus administrados para trabalhar buscando atender aos interesses sociais.<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O patrim&ocirc;nio P&uacute;blico &eacute; formado por bens de toda a natureza e esp&eacute;cie que interessem para a gest&atilde;o p&uacute;blica e para a popula&ccedil;&atilde;o em geral. Assim, o patrim&ocirc;nio da administra&ccedil;&atilde;o p&uacute;blica pode ser formado por bens de qualquer natureza que sejam pertencentes ao patrim&ocirc;nio p&uacute;blico.<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O C&oacute;digo Civil Brasileiro, em seu art. 99 classifica<i>:<o_p><\/o_p><\/i><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;<\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt 4cm; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&ldquo;<i>Art. 99. S&atilde;o bens p&uacute;blicos:<\/i><o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt 4cm; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><i><span style=\"font-family: Arial, sans-serif; background-position: initial initial; background-repeat: initial initial;\">I &#8211; os de uso comum do povo, tais como rios, mares, <b><u>estradas<\/u><\/b>, ruas e pra&ccedil;as (&#8230;).<o_p><\/o_p><\/span><\/i><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt 4cm; text-align: justify; background-position: initial initial; background-repeat: initial initial;\"><i><span style=\"font-family: Arial, sans-serif; background-position: initial initial; background-repeat: initial initial;\"><o_p>&nbsp;<\/o_p><\/span><\/i><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O poder p&uacute;blico tem o dever legal de conservar e fiscalizar as rodovias, bem p&uacute;blico de uso comum, garantindo aos administrados a seguran&ccedil;a no tr&aacute;fego. Esse dever tamb&eacute;m pode ser atribu&iacute;do aos membros da administra&ccedil;&atilde;o p&uacute;blica indireta, respons&aacute;vel pela presta&ccedil;&atilde;o de servi&ccedil;o p&uacute;blico descentralizado.<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; O C&oacute;digo de Tr&acirc;nsito Brasileiro, Lei 9.503\/98, constitui um importante instrumento de defesa quando ocorre omiss&atilde;o do estado na conserva&ccedil;&atilde;o das rodovias. Visa garantir o direito a um tr&acirc;nsito seguro, estabelecendo deveres e obriga&ccedil;&otilde;es do Poder P&uacute;blico no sentido de garantir trafegabilidade segura nas pistas.<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A garantia da correta sinaliza&ccedil;&atilde;o das rodovias, vem insculpida no art. 90 &sect;1&deg; do C&oacute;digo de Tr&acirc;nsito Brasileiro dispondo que &ldquo;[&#8230;] o &oacute;rg&atilde;o ou entidade de tr&acirc;nsito com circunscri&ccedil;&atilde;o sobre a via &eacute; respons&aacute;vel pela implanta&ccedil;&atilde;o da sinaliza&ccedil;&atilde;o, respondendo pela sua falta, insufici&ecirc;ncia ou incorreta coloca&ccedil;&atilde;o&rdquo;.<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; text-indent: 35.45pt; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family:\">&nbsp;<\/span><span style=\"font-family:\">Assim, considerando que a conserva&ccedil;&atilde;o das rodovias se trata de servi&ccedil;o p&uacute;blico de responsabilidade da administra&ccedil;&atilde;o p&uacute;blica (direta ou indireta), cabe a ela a manuten&ccedil;&atilde;o das estradas p&uacute;blicas de maneira eficiente e segura para os membros da coletividade, ou ainda, manter uma boa sinaliza&ccedil;&atilde;o para que se possam evitar danos<span class=\"apple-converted-space\">.<o_p><\/o_p><\/span><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; text-indent: 35.45pt; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span class=\"apple-converted-space\"><span style=\"font-family:\">Al&eacute;m de todo caos pela m&aacute; conserva&ccedil;&atilde;o das estradas que tem gerado preju&iacute;zo aos condutores de ve&iacute;culos automotores, os produtores tamb&eacute;m tem sofrido dificuldades para escoar a produ&ccedil;&atilde;o agr&iacute;cola para os demais estados.<\/span><\/span><span style=\"font-family:\"> Estima-se que o setor agr&iacute;cola teve um preju&iacute;zo de R$ 2 bilh&otilde;es nos &uacute;ltimos seis anos, sendo que, caso as estradas continuem nessa situa&ccedil;&atilde;o, o setor produtivo pode perder R$ 150 milh&otilde;es, o equivalente a 0,5% da produ&ccedil;&atilde;o.<o_p><\/o_p><\/span><\/p>\n<p style=\"margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 150%; background-position: initial initial; background-repeat: initial initial;\"><span style=\"font-family: Arial, sans-serif; background-position: initial initial; background-repeat: initial initial;\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; De acordo com <\/span><span class=\"apple-converted-space\"><span style=\"font-family:\">u<\/span><\/span><span style=\"font-family:\">m estudo elaborado pela Federa&ccedil;&atilde;o de Agricultura e Pecu&aacute;ria de Goi&aacute;s (Faeg), existem mais de 70 trechos nas estradas estaduais em p&eacute;ssimas condi&ccedil;&otilde;es, a quantidade de buracos e asfaltos trincados assusta os motoristas e causa preju&iacute;zos a popula&ccedil;&atilde;o. Segundo levantamento feito pela Confedera&ccedil;&atilde;o Nacional do Transporte (CNT), apenas 6% (seis por cento) da malha vi&aacute;ria estadual est&atilde;o em boas condi&ccedil;&otilde;es.<span style=\"background-position: initial initial; background-repeat: initial initial;\"><o_p><\/o_p><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">&nbsp;Em 2010, o governador destacou em seu Plano de Governo, a revitaliza&ccedil;&atilde;o de todo o sistema rodovi&aacute;rio do Estado, cujo objetivo era recuperar as rodovias e implantar um programa de manuten&ccedil;&atilde;o permanente. Neste plano, tamb&eacute;m previa a conclus&atilde;o de todas as obras rodovi&aacute;rias paralisadas ou inconclusas no Estado, garantindo duplicar a GO-020, inicialmente at&eacute; Bela Visa, concluir a GO-040 at&eacute; Aragoi&acirc;nia e o viaduto no setor Madre Germana, al&eacute;m de concluir a GO-070 at&eacute; Inhumas, em seguida at&eacute; a Cidade de Goi&aacute;s. Outro ponto a ser duplicado seriam as rodovias estaduais que d&atilde;o acesso aos destinos tur&iacute;sticos do estado como Caldas Novas, Piren&oacute;polis, Cidade de Goi&aacute;s, Aruan&atilde; e outros. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">Apesar de todas as gest&otilde;es positivas feitas pela Assembleia Legislativa ao aprovar a Lei 17.297\/2011, que cria o Fundo de Transportes &ndash; FT, com natureza or&ccedil;ament&aacute;ria e ainda, a permiss&atilde;o do Governo Federal para aumentar o poder de endividamento do Estado para que Goi&aacute;s pudesse junto ao BNDES captar 1,5 bilh&atilde;o, a ser gasto no Programa Rodovida, n&atilde;o foram suficientes para que as estradas do Estado fossem&nbsp;<\/span><span style=\"font-size:12.0pt;line-height:150%;font-family:\">recuperadas da forma que havia sido previsto. Com isso, a gest&atilde;o do estado, com uma d&iacute;vida que pode perdurar por mais de 20 anos.<o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">Passados dois anos, a realidade &eacute; que o&nbsp; Programa de Reconstru&ccedil;&atilde;o, Manuten&ccedil;&atilde;o e Conserva&ccedil;&atilde;o de Rodovias Estaduais (Rodovida) completou apenas 2 mil quil&ocirc;metros de recupera&ccedil;&atilde;o das estradas. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">&nbsp;Nesse per&iacute;odo, o governo lan&ccedil;ou o cronograma de execu&ccedil;&atilde;o das obras, em que no Grupo I, seriam constru&iacute;dos 2.081 quil&ocirc;metros, estimados em R$ 386 milh&otilde;es. No Grupo II, a previs&atilde;o &eacute; de 2.119 quil&ocirc;metros, contratado por R$ 539 milh&otilde;es, e por fim o Grupo III, ir&aacute; construir <st1_metricconverter productid=\"1.230 quil&ocirc;metros\" w_st=\"on\">1.230 quil&ocirc;metros<\/st1_metricconverter>, estimado em R$ 228 milh&otilde;es. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">Em uma an&aacute;lise feita pelos jornalistas da R&aacute;dio 730 em fevereiro deste ano, os 70 trechos de novas rodovias ainda nem come&ccedil;aram a ser executados.&nbsp; E dos 35 trechos j&aacute; licitados, 28 aguardam o in&iacute;cio das obras. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">Em entrevista coletiva a imprensa no final de janeiro, o presidente da Ag&ecirc;ncia Goiana de Transportes e Obras P&uacute;blicas (Agetop), Jayme Ric&oacute;n disse que as estradas continuar&atilde;o esburacadas at&eacute; abril, &eacute;poca em que se encerra o per&iacute;odo chuvoso. Para tentar amenizar os problemas, a Agetop intensificou os servi&ccedil;os paliativos, por&eacute;m foram paralisados por serem considerados como ineficazes por t&eacute;cnicos da Agetop. As opera&ccedil;&otilde;es tapa-buracos que estavam sendo feitas em algumas das piores rodovias de Goi&aacute;s tamb&eacute;m deixaram de ser realizadas. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">Quem anda pelo interior do Estado v&ecirc; uma realidade distante daquela que passa nas propagandas de TV. As rodovias em p&eacute;ssimas condi&ccedil;&otilde;es est&atilde;o presentes em todas as regi&otilde;es do Estado. Nosso levantamento mostra no m&iacute;nimo 58 trechos esburacados, Situa&ccedil;&atilde;o que precisa ser revista. O governo e a Agetop devem esclarecer que n&atilde;o &eacute; por falta de aus&ecirc;ncia de recursos que as rodovias estaduais est&atilde;o nessa situa&ccedil;&atilde;o. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-indent:35.45pt;line-height: 150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">A situa&ccedil;&atilde;o &eacute; ca&oacute;tica, trecho como a &nbsp;GO &#8211; 206 que liga Chapad&atilde;o do C&eacute;u at&eacute; a cidade de Serran&oacute;polis, j&aacute; deveria ter sido pavimentado. A regi&atilde;o recebe uma das maiores usinas que necessita todos os dias da rodovia. No local, apenas placas sinalizam o lan&ccedil;amento da constru&ccedil;&atilde;o do asfalto, mas at&eacute; o presente momento nada aconteceu. Tanto nessa GO, quanto em outras que listamos a baixo, os motoristas s&atilde;o obrigados a fazer zig-zag pela rodovia, avan&ccedil;ando pela contram&atilde;o e muitas vezes pelo acostamento. <o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;line-height:150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;<\/span><span style=\"font-size:12.0pt;line-height:150%;font-family:\">Listamos algumas rodovias que est&atilde;o em m&aacute; estado de conserva&ccedil;&atilde;o:<o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;line-height:150%\"><b><span style=\"font-size:8.0pt;line-height: 150%;font-family:\">&nbsp;<\/span><\/b><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;line-height:150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">GO &#8211; 174 &#8211; Rio Verde e Montividiu.<o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;line-height:150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">GO &#8211; 178 &ndash; Jata&iacute; a Itarum&atilde;<o_p><\/o_p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;line-height:150%\"><span style=\"font-size:12.0pt;line-height:150%;font-family:\">GO &#8211;
